P11 UPDATES -- 28 October 2009
1. Letters , dated 20thOct.09, for handing over of vacant possession have been sent out to the buyers.
Buyers please note of the following before the keys can be handed over by the developer.
i. The last 20% payment of the purchase price will need to be settled first. Invoice and demand have been sent out and , to avoid any delay, please laise with the financiers.
ii. Need to settle the assessment fees for year 2009 , esp. those that on financing facilities.
iii. The TNB and Syabas deposits and processing fees need to be settled within 14 days of the date of the notice.
2. LAD Claim from insolvent ACSB.
The Protem comm. is in the process of preparing the guidelines for the above purpose. Please be prepared with the details and documents for the same. We need to consider whether to claim as a group or individually and whether to go through the Housing Tribunal or the Courts.
3. Shoplots/ Office:
The proposed meeting with PJH is scheduled for:
Tuesday 3 Nov. 09 @ 9 am.

P11 UPDATE 21 October 2009
1. Garden Resort Homes are completed and Certificate of Fitness has been issued.
PJ Homes is in the process of handing over vacant possession:
Letters to the effect have been sent out to the buyers and their financiers. Expect to receive the letters soon.
Only one buyer has not signed the new SPA as yet.
2. Amber Homes.
Work are progressing well and on schedule.
There are still some buyers yet to sign the new SPA. We would like to appeal to those concerned to cooperate and do the needful.
3. Saujana Aster Apartments:
Work are on going to complete the project.
There are also a fair number of buyers who are yet to sign the new SPA. Those concerned please do the needful.
Note from PJH for those that do not sign the new SPA:
1. Reminders and ultimata will be sent out soon to those concerned.
2. Failing to respond within the specified time frame given, PJH will initiate procedures to repossess the properties accordingly.
4. Additional notes on Shoplots / Office
The buyers of the shop lots in Precint 11 have discussed amongst them and proposed to complete the construction of the shoplots with their own resources. In this connection, we have requested for a meeting with PJH to discuss this possibility and the implications.
PJH will be responding to the request soon.
Precint 11 , Putrajaya , are now freely accessible to the public. All are welcome to see the developments themselves. However , the houses under redevelopments are boarded up and off limit to the public. One may need to get permission from the site supervisor to go in.

Signing of New S & P for Saujana Aster
1.SAUJANA ASTER
Calling ALL Saujana Aster purchasers: New SPA signing date:
Monday 13th July 2009 @ 9 am

Note:
We need at least 80% signatories . Failure to get this number may cause the
redelopement of Aster Condominium to be further delayed. For the good of everybody, please make every effort to attend and execute the SPA on this date.

2.AMBER
There are still about 20 purchasers who are yet to sign the SPA. Those concerned, please contact PJH and make the arrangement for the signing. If there are any difficulties or queries , please contact PJH or the Protem Comm members. We don’t want to delay the redevelopment of Amber houses.
3.GARDEN RERSORT
New SPA have been stamped and ready for collection. Purchasers need to regularize the payment for the remaining phases with their respective financiers . They need to present to their financiers the following :
i.Stamped SPA and
ii.Letter of termination of the old SPA
Purchasers may need to sign a supplemental agg. for this purpose.
Only 3 buyers yet to sign the SPA.
PJH has already billed , Payment Schedule 2.f, 2.g and 2.h (15%)
This is the last portion before the handing over of the vacant possession.
Add. note. CSRU purchasers:
CSRU : The " 20-year moratorium " is a contract between the purchaser and the government. This does not involve the new developer, PJH. To alter this will need referral and negotiations with the relevant authorities, namely Kem. Tanah Wilayah, Treasury etc and this will take time and unfortunately, we do not have the luxury of time. ACSB is on the way to being declared insolvent. The whole project will be frozen if this happen.
As such , to expedite matters and for the benefit of the majority of purchasers who are not CSRU buyers, it was decided to retain this clause, unchanged as in the original SPA.
However, once this project is officially restarted, the CSRU purchasers may initiate negotiations with the relevant govt agencies, to address this issue. We may push for a supplementary aggreement to alter this clause.

SIGNING OF NEW S&P FOR CITRINE & AMBER

New developer, Putrajaya Homes Sdn Bhd are in the process of organizing the signing of the new “Sales and Purchase Agreement” ( SPA). All buyers are reminded again to please submit your particulars and documents ( please refer to previous postings in this blog for the details ) to the developer or PJH . These are required to prepare your new SPA.
Those concerned ( that have not submitted yet ) please do so as soon as possible.
Signing of new SPA are done according to phases. These will be held at
Menara PJH, Putrajaya @ 10 am
i. Garden Resorts ( Zone 10A -1) -- Tuesday 2nd June 2009
ii. Amber Homes (Zone 10A-2) -- Monday 22ndJune 2009
iii. Citrine (SemiD) (Zone 10B) -- Monday 22ndJune 2009
( Saujana Aster Condo. -- Date and time will be fixed later.)
The new SPA will be signed by the relevant parties and stamped by
the developer.
Below are summarized the steps that need to be taken by buyers to complete the process ( attached is a sample letter from PjH for referral)
The next step will be to regularize the existing loan agreement with the Financier and to enable the remaining loan amount to be released to the new Developer, Putrajaya Homes Sdn. Bhd., the following documents are proposed to be executed and perfected between you and your Financier:.
(A) For Landed Properties (Garden Resort/Amber Homes/Citrine)
0) Supplemental Agreement to the Loan Agreement;
(B) For Strata Properties (Sau'ana Aster)
(I) Supplemental Agreement to the Loan Agreement
(ii) Deed of Revocation for the Deed of Assignment
New Deed of Assignment
5. Further to the above, there will be stamp duty payable to the Stamp Office and legal fees payable to the Financiers' solicitors to perfect the same. ( the legal fees are negotiable between buyers and their respective financiers )
6. As already highlighted to you, the Schedule of Payment in the new Sale and Purchase Agreement ("the New SPA") shall differentiate between the payment made to Arif Cerah and payable to Putrajaya Homes Sdn. Bhd. the same of which will be based on the last progress billing issued by Arif Cerah to you. However, if any of the progress billing has yet to be settled, you are advised to take the necessary action to settle the same immediately upon the New SPA is executed as the delivery of vacant possession of the property to you is subject to the full settlement of the purchase price.

Updates P11 New S & P – 30 May2009
- New developer , PJH is now in the process of preparing the new SPA .
There is some legal problem with the signing of the “ Deed of Revocation “ for the old SPA. As replacement , this document will be replaced by a “Termination Letter “ which will serve the same purpose. . A sample of these letters are posted here.
The financiers may also require the purchasers to sign a “supplemental
Agreement” to support this Termination Letter. This agreement will be prepared
for the purchasers
- Buyers are advised to submit ALL the relevant details as required by the new developer (PJH) as soon as possible, so that their new SPA can be prepared.

- The first batch of new SPA involving 14 buyers from Garden Resort are ready to
for signing on Tuesday 2 June 09.

The above meeting was held successfully. Below are the salient points to be noted by ALL buyers , especially the ASTER Condo. buyers who are due for a similar meeting this Saturday 25th.April 2009.

ii.ACSB has been liquidated and its functions are in
the hands of the official liquidators.
iii.The Deed of Revocation will be prepared and signed by the “Liquidator” and will be ready together with the new SPA for the buyer to sign. This is expected to be ready in about 2 weeks.
iv.Buyers will need to take the signed Deed of
Revocation and the stamped new SPA to their financier to get the new Letter of Undertaking ( LOU )
v.Frequent asked questions are listed in attachment 2.
vi. Request for access to the project to see our houses
cannot be approved. This involves questions of safety,
thefts etc and legal liability on the part of the
developer. Guided visit or tour may be arranged.
v. For P11 house owners who could not make it last Saturday, pls try to make this Saturday meeting so we could speed up this project with all the paper work being updated.

Pjh Meeting with Aster Condo Owners
To all Aster Owners
Pls do come to the meeting on the Saturday 25 April 09 and update your particulars with PJH.
I was there last Saturday and it was very professionally handle.
The meeting will last 1 hour and a Q n A session will be held after that.
Pls bring all relevant documents pertaining to yr apartment.
You will need to sign 2 documents, TNB and Water release form.
They will be PJH staff to assist u and photocopy machines to copy yr documents.
Light refreshment will be served
The PJH building is opposite the Custom Building and Finance Ministry building next to the river. Ample parking space.
I will be there and a reminder for the contribution of RM 100 for our legal fund is much appreciated.

Update on P11 Progress – 26 March 2009
1. The new SPA is still being finalized by all the parties namely PJH ( Putrajaya Homes ), KPKT, CIMB , ACSB and of course our lawyer, Zainal Abidin & Co.
All major issues are settled and agreed upon. Whats left are only the final wordings to the clauses as all the parties are very particular as to protect their interests.
PJH is still waiting for the approval of the final draft from the KPKT.
2. PJH have already sent out letters to the financiers of the buyers
( beginning with Garden Resorts Homes ) to inform them of the latest
state and what commitments are expected from them and the buyers. A meeting between the financiers and PJH is scheduled to be held on Wed. 1st,April 09.
3. PJH is supposed to organize a meeting with the buyers to brief the buyers on this. We should be hearing from them soon.

UPDATES ON P11 --- 17 FEBRUARY 2009
1. Re. Saujana Aster Condo: PjH proposed the common facilities to be completed in 36 months. Counter proposal by buyer, that these facilities be completed together with the earliest phase of the condo. project, so that those facilities will be available for the residents that move in first. PjH agreed to look into this.
2. Re: 20 year moratorium civil servants scheme. The 20 year term will commence from the date of transfer of deed and will not be changed, as this involved the land office. Changing it ( will need to involve the land office) will cause more delay.
3. The new SPA has been vetted and approved by the Jabatan Undang2.
4. Buyers role:
i.. Need to sign Deed of Revocation for the old SPA signed with ACSB
ii. Need to inform their financiers re. the transfer of development to the new company. PjH will assist them in this.
5. Buyers Briefing : PjH will hold a meeting to brief all the buyers as soon as they are ready with the details.
6. Target dates: i. Signing of new SPA --- Mid March 2009
ii. Work on housing project to start in April 2009
( Details of work schedule will be presented at the proposed
meeting between PjH and the buyers)
PROTEM COMM. REPORT
1.
The protem comm. is helping and working with the KPKT and PJH in getting this project to start as as possible .
We are providing them with ALL the contacts (address , e mail, phone nos, etc ) so that the documents can be passed on without delay. We request that buyers who have changed their contact details or who knows about others buyers details , to update the protem comm.. Please contact your phase rep. or any of the protem comm. members.
2.
We hope to settle this problem soon. Which means that we need to meet our financial obligations especially to our legal adviser for their advice and assistance. The protem comm. requests that buyers help us by settling your due of RM 100 each as contributions to our finances. Please remit your payment as instructed in this website.

New Year Update 09 January 2009
1. Early December 2008 : Protem Comm sent out letters to the following:
a. Minister of Housing & Local Govt. Dato Seri Ong Ka Chuan
b. Minister of Fed Territory. Dato Seri Zulhasnan Rafique
c. Member of Parliament Putrajaya, Dato Seri Tg Adnan Tg Mansor
and cc all the letters to the Prime Minister and the Dep. Prime Minister.
Contents: Highlighting our problem and plight with regard to this delayed project P11. Requesting their help in pushing for some conclusion.
2. Response:
a. President of Perbadanan Putrajaya, Tan Sri Samsudin Osman, convened a meeting between Perbadanan Putrajaya, PJH and KPKT on Monday 5th Jan 09. Some concrete decisions were reached at this meeting hence the proposed meeting at Perbadanan Putrajaya on Wed 7th. Jan 09 involving the Protem Comm was cancelled.
b. A meeting was held today, Friday 9th.Jan 09 at the KPKT convened by the Jab. Perumahan Negara ( Govt. housing projects monitoring agency ) involving: KPKT , PJH, ACSB, CIMB and the Protem Comm. The following decisions were made.:
i. A new Minister Order will be issued for PJH to take over the project
ii. PJH has agreed in principles to all the terms of the new order and will apply for the development rights .
3. ACSB will simultaneously apply to transfer that dev. Rights to PJH.
4. All buyers will be required to sign a new S&P Agg. With PJH. All the terms will be as agreed upon earlier on by all parties ( no change at all )
5. If all goes as planned, work should start , latest by April 2009.
Protem Comm. made the following commitments on behalf of the buyers:
1. Buyers ( more than 80% of those contacted ) agreed that PJH will NOT be
held liable to the LAD stipulated in the old S&P agg signed with ACSB.
But maintained our right to pursue that claim from ACSB.
2. Buyers , together with PJH, will laise with the financiers as to the
change in the developer.
The Protem comm. will update the members from time to time

Due to a posting in a blog recently, kindly be informed that a copy of sales and purchase agreement must be attached/mailed/e-mailed with your application on surat pengesahan projek bermasalah to our department. This is for verification purposes only.
Please acknowledge us on these following:
a) your mailing address and contact number
b) recipient and the recipient's address (such as the financier, KWSP).
b) collection method - by hand when the letter is ready OR the request to mail directly to you and your recipient
You also can come to our Kaunter Aduan, Bahagian Penguatkuasa, Blok B Utara, Pusat Bandar Damansara, Kuala Lumpur for the same application.
